Terms for Auday Local Privacy Edition.

01 · Provider and applicable documents
These Terms of Service govern use of Auday Local Privacy Edition for iPhone and Apple Watch, provided by GUO HANGJIANG, an individual developer (the “Developer”). The contact address for service questions is baifu.guohj@gmail.com.
For an App Store copy licensed under Apple’s Standard End User License Agreement, that agreement governs the software license. These Terms describe the app’s features and their use and are not intended to replace that license. The Privacy Policy separately explains information handling. Reading or accepting these Terms is not a substitute for any specific privacy permission required by law.
02 · One-time purchase and included updates
The Local Privacy Edition is a one-time purchase. No Auday subscription is required for its included local features, and updates released for this edition are included. A purchase grants use under the applicable license; it does not transfer ownership of the software.
Future online services may be offered separately with their own prices and terms. They are optional and are not included in this purchase. No particular future feature, release date or indefinite compatibility with every future operating system is promised. These statements do not reduce any mandatory consumer rights.
03 · Responsible recording and use
You are responsible for ensuring that you may lawfully record, store and use the content you capture. Give any notice and obtain any consent or other authorization required where you record, including for confidential conversations and private spaces. The same responsibility applies before sending recorded information about another person to an AI provider.
Do not use the app for unlawful surveillance, to infringe privacy or intellectual-property rights, or otherwise in violation of applicable law. The app does not determine whether a particular recording is lawful.
04 · Recording and synchronization limits
Auday is designed for all-day recording initiated by you. It does not guarantee uninterrupted 24-hour coverage. Battery level, storage, calls, Siri, system alerts, device connectivity and app or operating-system interruptions can stop recording or delay transfers and processing.
Continuous recording does not mean that transcripts, AI results or body and place context appear at the same moment. They become available after the required collection, synchronization and processing.
Check the recording state during important sessions. If a recording has ended, start a new one on your Watch. Audio that was never captured cannot be recovered. Timing, battery and storage figures in the app are estimates or usage observations, not performance guarantees.
05 · Health, stress and location context
These optional features associate available body and place signals with recordings. Stress labels are Auday’s algorithmic estimates of physiological strain relative to your personal baseline, not a directly measured stress level or an Apple-provided stress diagnosis. HRV is one input; it is not interchangeable with stress or emotion.
Baseline availability depends on sufficient suitable historical measurements. There is no fixed number of days after installation at which accuracy is guaranteed. Estimates can be missing or wrong, and Auday has not established a clinically validated stress-detection accuracy rate. “Feeling good” indicates an estimated lower physiological strain; it does not establish that you felt happy.
Updates depend on measurements becoming available on your iPhone and on system processing opportunities. No continuous, second-by-second or fixed-latency stress monitoring is promised. Place labels are approximate and do not prove attendance at a venue. Neither a body label nor a shared timestamp establishes who was speaking or what caused a state. These features are for personal reflection, not medical monitoring, diagnosis or emergency use.
06 · Third-party AI services and charges
AI features require a provider and endpoint you configure. You manage that provider account and its credentials. Provider fees are separate from the app’s purchase price, and enabled automatic processing can generate billable requests.
Relevant text and context are sent directly from your iPhone to the selected endpoint as described in the Privacy Policy. Provider availability, models, rates and data practices may change independently of Auday. Removing a local configuration does not cancel a provider account or delete its records. Only use services and data for which you have the necessary authorization.
07 · Accuracy and appropriate reliance
Transcription and AI output may contain omissions, incorrect statements or mistaken inferences. The app currently supports Chinese and English transcription and does not identify individual speakers. Check important details against available original audio and other reliable sources.
Summaries, Highlights, remembered facts, information-density scores and body-context interpretations are aids to recall. They are not medical diagnoses, professional advice, guaranteed evidence or authoritative accounts of what happened. Do not rely on them alone for decisions affecting health, legal rights or other significant interests.
08 · Your content and local storage
You retain your rights in recordings and other content you lawfully create or use. These Terms do not give the Developer ownership of your archive or a general right to use it for training.
You control the devices on which the archive is stored and the app’s audio-retention settings. Removing original audio does not remove saved text. The archive is excluded from device backups and has no Auday server copy. Preserve important information separately; the Developer cannot restore content that no longer exists on your devices.
09 · Third-party software and model licenses
Included third-party software and models are governed by their respective licenses. The required notices and license texts are available through Open-source licenses below. Those licenses govern the components to which they apply, and these Terms do not restrict rights granted by them.
EmbeddingGemma is subject to the Gemma Terms of Use, including Section 3.2 and the incorporated Gemma Prohibited Use Policy. You must not use Gemma for the prohibited uses identified there or in violation of applicable law. Both documents are linked in Open-source licenses below.
10 · Purchases, refunds and statutory rights
App Store billing and refund requests are handled through Apple’s applicable processes. Any rights provided by mandatory consumer-protection law continue to apply; no statement here removes them.
To the extent permitted by law, the app is provided as available without a promise of uninterrupted or error-free operation. Nothing in these Terms excludes liability that cannot lawfully be excluded, excuses a failure to provide legally required remedies or overrides the applicable software license. No exclusive foreign court or mandatory private arbitration is imposed by these Terms.
11 · Changes and future services
Material changes to these Terms will be made available with an appropriate notice and will not remove rights that cannot lawfully be changed. Where a change requires agreement under applicable law, notice alone will not replace it. A separately offered online service will be described and priced separately before you choose to use it.
